Zimbabwe Elections on 31 July: MDC-T Blasts Court for Being “Political”
The MDC-T led by Prime Minister Morgan Tsvangirai has said  that the court decision to go ahead with elections on 31st July reveals  the court has indulged itself in politics rather than aligning itself with the law.
The party’s spokesman Douglas Mwonzora said the court decision was political and not legal.
Mwonzora said the ruling is not surprising and accused the judges of showing bias in favour of Mugabe. “This was a predictable ruling by the constitutional court because it was clear it was going to make a political decision rather than a legal decision.
“This application was destined to fail anyway because it was poorly written by the Minister of Justice who wanted this particular outcome.”
Mwonzora told SWRadio Africa that the reason why the MDC-T wanted a postponement was so that people would be given ample time to register and inspect the voters’ roll.
All other requests for the election date to be removed were also turned down.
Mwonzora said the court did not take seriously the applications by ‘alien’ Mariah Phiri and human rights activist Nixon Nyikadzinowho also appealed for a delay saying their rights would be violated if elections are held this month.  “All that has been sacrificed because the Constitutional Court did not want to displease the emperor,” Mwonzora added.
 
Zimbabwe’s elections are set to go ahead on the 31 st July as decreed by the Court earlier, despite SADC resolutions that they should be delayed by two weeks to 14 August, a recommendation platooned and seconded by the two MDC parties at the recent Extra Ordinary SADC Summit in Maputo.
Chief Justice Chidyausiku who earlier ruled that President Mugabe should announce election dated no later than 31 July, yesterday re-announced  that elections have to proceed in accordance with president Mugabe’s earlier proclamation.
“For the avoidance of doubt, elections should proceed on the 31st of July in terms of the proclamation by the president of Zimbabwe in compliance with the order of this court,” Chief Justice Godfrey Chidyausiku said.
The reasons for the verdict were not immediately available at the time of writing with the court promising to send them at a later time.
Before yesterday, many analysts had concluded that it was too late and would be difficult president Mugabe to change the 31st July date  as it would amount to political defeat for Mugabe to accept SADC recommendations.
Prime Minister Morgan Tsvangirai had applied for a 25-day delay from the July proclamation by Mugabe last month.
mwonzora3But the court said Thursday that Tsvangirai should have sought the delay soon after the judgment instead of waiting for Mugabe to announce the date.
“He left it to the President to do want he wants or else he could have come to the court sooner,” said one of the nine-judge court, Justice Luke Malaba.
Malaba said Tsvangirai’s reluctance to approach the courts earlier “meant he was happy with the date.”
Still, Tsvangirai’s spokesman Luke Tamborinyoka said the MDC-T leader would abide by the court ruling.

  2. @ hustler lets agree vote rigging started with Mugabe then followed by the judges. Lets remember that the same bandits also installed Mugabe as president after he ‘resoundingly’ won a one man election in 2008. A bandit will never be fair. Bandit ndi bandit basi! The own goal bandits at Zanu Pf are clearly happy the referee is a Zanu Pf bandit. Election disputes have started much earlier than anticipated.

  6. The Zanu judges of that kangaroo court have demonstrated a disgusting partisanship!! Their rulings are not informed by the law of the land but by Jongwe House. Ok let the elections come!!! We are more than ready to braai the Zinja PF party!!
